Please read these Terms of Use carefully before using the Nudge mobile application or website. These Terms form a legal agreement between you and Nudge ("we," "us," or "our") governing your access to and use of the Nudge service.
By downloading, installing, or using the Nudge mobile application or visiting our website, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these Terms, do not use the service.
You must be at least 13 years of age to use Nudge. If you are between 13 and 18 years of age, you must have the permission of a parent or legal guardian to use the service. By using Nudge, you represent that you meet these age requirements.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Your continued use of Nudge after the effective date of any changes constitutes your acceptance of the revised Terms.
Nudge is a mobile productivity application that allows users to subscribe to curated event feeds — structured collections of reminders and tasks related to areas of life such as vehicle maintenance, home upkeep, healthcare, pet care, and personal finance. By answering a short intake form, users receive personalized, timed reminders generated from templates.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.
To use Nudge, you must create an account using a valid email address or by signing in with a supported third-party authentication provider (currently Google). You agree to provide accurate, current, and complete information during registration and to keep this information updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at legal@nudge.app if you suspect any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain account security.
Each person may maintain only one Nudge account. Creating multiple accounts to circumvent account restrictions or bans is prohibited.
You may delete your account at any time through the Profile > Account Settings menu in the app. We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law.
You agree to use Nudge only for lawful purposes and in accordance with these Terms. You agree not to:

You are solely responsible for content you submit. We do not endorse user-submitted reviews and make no representations about their accuracy. We reserve the right to remove any content at our discretion, including content that violates our acceptable use standards.
Nudge may offer feeds created by third-party providers. We do not endorse, guarantee, or take responsibility for the accuracy, completeness, or quality of third-party feeds. Third-party providers are solely responsible for the content and accuracy of their feeds.
Nudge may display links to third-party websites, service providers, or products within the "Let's Go" and suggestion features of the app. These links are provided for convenience only. We do not endorse any third-party products, services, or websites, and we have no control over their content or practices. Your interactions with third-party services are governed by their own terms and privacy policies.
The Nudge application, website, logo, brand, and all content created by Nudge — including official feeds, event templates, UI design, text, graphics, and software — are owned by or licensed to Nudge and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from our proprietary content without our prior written consent.
You retain ownership of the personal information and data you provide to Nudge. You grant us a limited license to process and use that data solely to provide the service as described in our Privacy Policy.
If you submit feedback, suggestions, or ideas about Nudge, you grant us the right to use that feedback without restriction or compensation to you.
The Nudge service is provided "as is" and "as available" without warranties of any kind, express or implied.

Nudge is a reminder and organizational tool, not a professional advisor. Nothing in the app constitutes medical, legal, financial, veterinary, or other professional advice. Always consult qualified professionals for decisions in these areas. Nudge is not responsible for outcomes resulting from following in-app recommendations or reminders.
To the maximum extent permitted by applicable law, Nudge and its officers, directors, employees, agents, and licensors shall not be liable for:
These limitations apply whether the liability is based on contract, tort, strict liability, or any other theory, and even if we have been advised of the possibility of such damages.
In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, our liability is limited to the greatest extent permitted by law. In no event shall our total cumulative liability to you exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred dollars ($100 USD).
You agree to defend, indemnify, and hold harmless Nudge and its officers, directors, employees, agents, and licensors from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the service.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Nudge service shall first be attempted to be resolved informally by contacting us at legal@nudge.app. If informal resolution is unsuccessful within 30 days, disputes shall be resolved by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent unauthorized use of intellectual property or for urgent matters.
You agree that any arbitration or court proceeding will be conducted on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found unenforceable, then the arbitration agreement in this section will be null and void.
If you are a consumer resident in a jurisdiction where this arbitration clause is not enforceable, you may bring claims in the courts of your jurisdiction.
Nudge currently offers a free tier. Future premium features, paid feeds, or subscription tiers may be offered. Any pricing, billing terms, refund policies, and subscription management instructions will be disclosed clearly before any purchase is required and will be governed by any additional terms presented at the time of purchase.
If you purchase a subscription through the Apple App Store or Google Play Store, your purchase is subject to those platforms' payment terms and refund policies.
We reserve the right to suspend or terminate your access to Nudge at any time, with or without cause, and with or without notice, in our sole discretion. Reasons for termination may include, but are not limited to, violation of these Terms, extended account inactivity, or the discontinuation of the service.
Upon termination, your right to use the service immediately ceases. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.
We may revise these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you via email and/or in-app notice at least 14 days before the changes take effect. Your continued use of Nudge after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you should stop using Nudge and delete your account.
Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Nudge regarding the service and supersede any prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control.
